AHERA Notification
In 1987, the U.S. Environmental Protection Agency (EPA) promulgated the Asbestos Hazard Emergency Response Act (AHERA) under Title 40 Part 763, Subpart E of the Code of Federal Regulations. This rule requires local education agencies (LEAs) to identify friable and non-friable asbestos-containing material (ACM) in public and private elementary and secondary schools by visually inspecting school buildings for such materials, sampling such materials if they are not assumed to be ACM, and having samples analyzed by appropriate techniques referred to in this rule.
In keeping with this legislation, the Upper Merion Area School District was inspected by EPA accredited inspectors and a comprehensive management plan was developed for handling asbestos containing building materials in a safe and responsible manner.
A copy of the asbestos management plan is available for review in the district's Operations Office.
This notice is to inform all parents, faculty and staff of the availability of the asbestos management plan for each building under the jurisdiction of the Upper Merion Area School District, as required by law. In accordance with the Asbestos Hazard Emergency Response Act (AHERA), 40 CRF Part 763.93. AHERA regulations require re-inspections of all ACBM every three years by an accredited building inspector, and this includes an update of the Management Plan.
The AHERA regulations also require surveillance inspections of all ACBM every six months by an individual with training and knowledge of ACM.These reports and management plan updates are also available for review by any interested person in the District's Operation Office during normal working hours. Element Environmental Solutions, Inc. (E2S) has been contracted by Upper Merion Area School District as the District’s Environmental Consultant and AHERA Designated Person, to provide the required re-inspections, and assist Upper Merion Area School District in compliance with all other requirements of AHERA.
The following buildings are documented as containing no known or accessible ACBM due to new construction, or renovations in which all known and accessible ACBM was removed:
- Upper Merion Area High School
- Upper Merion Area Middle School
- Bridgeport Elementary School
- Caley Elementary School
- Candlebrook Elementary School
- Gulph M. Welch Elementary School
- Roberts Elementary School
